BY CONTINUING WITH THE PAYMENT FOR ANY EVENT, YOU ARE AGREEING TO THE FOLLOWING (PARTS 1-9)
1. TERMS USED
a.RappRacing, RappracingUK, MadRon, Mad-Ron, X-RON and Julian Rapp are all operating names of Julian
b.The term “Event” relates to anything organised as a single occurrence, multiple occurrence, annual event or part of a package. It is not a term that relates to competitive racing.
2. EVENT
Event, race, competitor or any other term used in advertising or during the event do not coerce attendees to ride quicker than they themselves deem safe for the conditions at the time. Any other terms used in advertising or the during the event are incidental and carry no competitive inference.
Timed sections are the exception to the above and due risk assessment will be made.
3. YOUR RESPONSIBILITY
In consideration of my (the participant) being permitted to utilise the transport, training, practice, event facility and routes organised by RappRacingUK (Julian Rapp), I agree to save harmless and keep indemnified RappRacingUK, the Officials, Servants and Representatives or Agents, the Landowner and other persons using this facility, from and against all actions, claims, costs, expenses and demands in respect to death or of bodily injury to or damage to the property of myself howsoever caused, arising out of or in connection with my participating in training, practice or an event and notwithstanding that the same may have been contributed to or occasioned by the negligence of the said bodies or persons, their Officials, Servants, Representatives or Agents.
I understand that should I at the time of this event be suffering from any disability or condition whether permanent, temporary or otherwise which is likely to affect prejudicially my control of the vehicle, and/or represent a danger to myself or other persons, I may not take part.
Neither party shall be liable in damages or have the right to terminate this agreement for any delay or default in performing hereunder if such delay or default is caused by conditions beyond its control including but not limited to acts of God, government restrictions (including the denial or cancellation of any export of other necessary license), wars, insurrections and/or any other cause beyond the reasonable control of the party whose performance is affected (including mechanical, electronic, or communications failure).
4. BOOKING AND PAYMENTS
The deposit paid at the time of booking forms part of the total cost of the package and will not be refunded. If NO payment schedule is inferred in an event’s information, full payment is due in full no later than 6 weeks before the event. If the payments due have not been received by the specified date, you risk forefeiting your preferential/discounted rate, your place, money paid.
5. CANCELLATION
Refunds on a balance of payment (paid or not paid).
Payments are usually requested at a schedule unique to each event, this schedule is usually outlined within the event’s information. Once the payment date is passed the funds become both due and non refundable. Over-payment in advance of the schedule is refundable in full.
If NO refund schedule is inferred in an event’s information, refunds are structured as follows.
60 or more days before event, loss of deposit only
43 – 59 days before start of event (or the events transport departure if earlier) – 50 % refund of balance
14 – 42 days before start of event (or the events transport departure if earlier) – 25% refund of balance
0 – 14 days before start of event (or the events transport departure if earlier) – NO REFUND
Not attending the event for any reason constitutes a 0-14 day cancellation and therefore no refund will be paid.
6. RIDER TRANSFER
Transferring your place is acceptable with our written permission. This is with the understanding that:
we are compensated in full for any further associated costs incurred to do so
the terms to which you agreed are also transferred to the new customer.
7. INSURANCE DURING TRANSPORT
Motorcycles cannot be covered as Goods in Transit. But can be covered very easily on your own policy. You should therefore inform your insurer in writing that your Motorcycle is being carried abroad, within Europe, inside a third party vehicle. This must be sufficient to indemnify RappRacingUK against the cost of losses or damage incurred whilst in possession of RappRacingUK.
8. MOTORSPORT IS DANGEROUS
Following the guide, marked route, gps route or any officials, servants, representatives of RappRacing does not infer safe passage!
RappRacing provides guided and gps’d routes incorporating both road and off-road; you are not being compelled to strictly adhere to them! All of the routes are to be ridden at your own pace and only when you have judged all of the upcoming terrain over which the route passes to be safely within your riding ability. This also applies to any diversion from the route whether accidental, deliberate or required.
The routes have been ridden regularly, but because the terrain can change from day to day they should be considered to have not been ridden recently enough to check the are still useable. You must therefore judge for yourself whether you are able to ride them safely.
9. ROAD LEGAL
All routes should be ridden in accordance with the local laws. You should carry your
